Regulations on Disciplinary Sanction of Students at Jiangnan University

Article 1 These regulations are formulated to standardize the management of students, maintain the order of education, teaching and life on campus, protect the legitimate rights and interests of students, and nurture capable young people who are well-prepared to join the socialist cause and who develop all-around moral, intellectual, physical, and aesthetics capabilities. The regulations are enacted by considering the actual situation of the university and referring to relevant laws and regulations such as the “Education Law of the People’s Republic of China”, the “Higher Education Law of the People’s Republic of China”, and the “Provisions on the Administration of Students in Institutions of Higher Education” (Order No. 41 of the Ministry of Education of the People’s Republic of China).

Article 2 These regulations are applicable to all full-time undergraduates and postgraduates of Jiangnan University. If there are national regulations on disciplinary sanction for other types of students, the national regulations will be referred to; if not, the regulations hereafter mentioned will be applied.

Article 3 Disciplinary violations mentioned here include but not limited to academic dishonesty, behaviors in violation of laws and regulations, university discipline and rules, and social morality that students should abide by.

Article 4 The university shall give disciplinary punishment to the students who violate the regulations. If the violations are obviously minor and do not require disciplinary punishment, criticism and education shall be given.

Disciplinary sanctions should be given based on facts and according to the nature and severity of students’ illegal and violative behaviors, the purpose is to be both punitive and educational.

Disciplinary sanctions given to students shall be due in procedure, clear in facts, sufficient in evidence, solid in criteria, accurate in judgement and appropriate in implementation.

Article 5 Students shall have the right to make statement and to pleading. If there is any objection to the punishment, students shall have the right to file a written appeal. Students who think that the university and its staff violate laws and regulations and infringe on their legitimate rights and interests, or find the rules and regulations stipulated by the university in conflict with existing laws and regulations may complain to the Education Department of Jiangsu province.

Students whose behavior causes damage to others shall bear civil liability in accordance with the law. Students whose behavior constitutes a crime shall be investigated for criminal liability in accordance with the law.

Article 6 Disciplinary sanctions shall be completed and lifted according to the procedures established by the university except for the case of dismissal. Sanctions will not affect the commendation, reward and other rights and interests of the students once they are completed and lifted.

Chapter II Types and Application of Disciplinary Sanctions

Article 7 Types of disciplinary sanctions:

1) Warning

2) Severe warning

3) Demerit record

4) Disciplinary probation

5) Dismissal/Expulsion

Article 8 When two or more persons jointly violate school policies, they shall be dealt with separately based on the role played by each of them in the joint violation.

Students who instigate, intimidate, deceive or induce others to violate the policies shall be punished together with the actual perpetrator accordingly.

Article 9 Under any of the following circumstances, if verified to be true, violators may be given a minor or mitigated punishment:

1) Students who have minor misconduct.

2) Students who are coerced or deceived by others.

3) Students who fail to instigate, intimidate, deceive or induce others to commit behaviors of violation.

4) Students who take the initiative to bear civil liability and obtain forgiveness from the victim.

5) Students who admit mistakes after violation and show a good attitude and repentance.

6) Other circumstances under which the violators may be given a minor or mitigated punishment.

Article 10 Under any of the following circumstances, violators shall be given a severe punishment:

1) Those who cause serious consequences or adverse impact.

2) Those who deliberately obstruct and interfere in investigation and hinder the collecting of evidence.

3) Those who frame, entice, threaten, retaliate or take other measures to obstruct the investigators, prosecutors, witnesses, examiners, persons involved in the decision-making or others relevant persons

4) Those who refuse to admit the violation and have a bad attitude

5) Those who violate school policies again within the period of punishment

6) Those who lead or organize a mass disciplinary violation

7) Those who refuse to bear civil liability

8) Other circumstances

Article 11 Students who are subject to disciplinary sanctions will not be entitled to any kind of scholarships and honorary titles within the period of punishment.

Article 12 When a disciplinary violation infringes upon the rights and interests of the nation and the university, the violators shall bear civil liabilities according to the following conditions:

1) If economic losses are incurred, the property shall be returned, and losses be compensated, etc.

2) If reputation damage is incurred, an apology shall be made, bad influence shall be eliminated, and the reputation shall be restored

3) If the campus environment is damaged, it shall be restored to its original state or compensation be made for the losses

4) If there are other infringements, violators shall bear civil liabilities in accordance with the relevant civil laws and regulations.

The responsibilities of returning property, making compensation for losses, apologizing, and restoring to the original state as stipulated in this article may be handled together with the punishment, or may be applied independently in the case that students who violate the polices are exempt from disciplinary punishment. However, if it has been or is being dealt with in relevant judicial or state administrative procedures, it shall not be dealt with repeatedly.

Chapter III Disciplinary Violations

Article 13 Students who violate laws and regulations shall be punished according to the following regulations:

1) Those who violate the Constitution, undermine national stability and unity, and disrupt social order shall be expelled from school.

2) Those who violate national laws and regulations and are punished by judicial departments or public security organs shall be given the following punishments.

a) Those who are judged by the people’s court to constitute a crime and given criminal punishment shall be expelled from school.

b) Those who have been punished for behaviors that are egregious in nature and violate the public security regulations shall be put on academic probation or be expelled from school.

3) Those who set up illegal organizations, participate in activities by illegal organizations such as heresy, pyramid selling, etc. and do not repent after admonitions; those who organize and participate in unauthorized demonstrations, processions and gatherings despite admonitions; those who write and post leaflets endangering national security; and those who organize and incite riots, shall be placed on academic probation or expelled from school.

4) Those who publicize, organize or participate in religious activities in schools shall be punished with a warning or above depending on the severity of the circumstances.

Article 14 Academic misconduct shall be punished according to the following regulations:

1) Those who commit one of the following acts shall be punished with a warning, severe warning or demerit record.

a) Those who plagiarize others’ research results or articles shall be punished with a warning or severe warning depending on the severity of the case

b) Those who falsely give or tamper with the proof of articles published shall be punished with a severe warning or demerit record.

2) Those who commit one of the following acts shall be punished with a severe warning or demerit record. Some conduct, however, is so egregious in nature or so damaging to the educational environment that it requires more serious sanctions, including academic probation or dismissal.

a) Unauthorized transfer or use of intellectual property rights of the university.

b) Violation of the confidentiality rules, and divulgence of the university’s scientific and technological achievements (including technical secrets).

c) Other acts that infringe on the university’s IPR and damage the university’s legitimate rights and interests.

3) Those who have one of the following behaviors shall be expelled from school:

a) To purchase or sell thesis or graduation project.

b) To write thesis or graduation projects for others or pay for others to do so.

c) Severe academic misconduct such as plagiarism, tampering and forgery in thesis, graduation project or published research result.

d) To organize the sale of thesis or graduation project.

4) Other acts of academic misconduct shall be punished with a warning or above depending on the severity of the circumstances.

Article 15 Students who violate the attendance policies shall be punished according to the following regulations:

Students with absenteeism for more than 12 hours in a semester shall be punished with a warning; those for more than 20 hours shall be punished with a severe warning; those for more than 30 hours shall be punished with a demerit record; those for more than 40 hours shall be placed on academic probation; those for more than 60 hours or have not participated in the academic activities required by the university for two consecutive weeks shall be punished with a warning in accordance with the “Regulations on the Student Status Management of Jiangnan University”.

Article 16 Students who violate the rules for exams shall be punished according to the following regulations:

1) Those who violate the rules for exams shall be punished with a warning or severe warning.

2) Those who cheat in the exam shall be punished with a demerit record or above.

3) Those with severe cheating in the exam shall be put on academic probation or expelled from the university.

For the definition of the violation, cheating and severe cheating, please refer to the “Detailed Rules for the Implementation of the Regulations of Jiangnan University on Assessment and Management of Courses”.

Article 17 Students who infringe upon or damage property shall be punished in accordance with the following regulations:

1) Those who steal, swindle or encroach upon public or private property shall be punished as follows except for those who recover the stolen money and property or compensate for the losses:

a) If the property value is less than 1,000 yuan and the misconduct is minor, a demerit record or below shall be imposed; if the misconduct is severe, a demerit record or above shall be given.

b) If the property value is more than 1,000 yuan, and the case does not constitute a criminal or public security punishment, a demerit or above shall be given depending on the severity of the case.

c) If the Security Office of the university or the Public Security Department confirms it as an act of theft, a demerit record or below shall be given regardless of whether the property is lost or not.

2) Those who intentionally damage facilities such as doors, windows, desks, chairs, books, instruments, campus environment, flowers, trees and other public facilities, and damage properties of others, shall be punished with a warning if the case is minor, a severe warning or above if the case is severe.

Article 18 Students who violate the order of network management shall be punished according to the following regulations:

1) Those who intentionally or negligently disseminate false information or infringe upon the reputation or privacy of others shall be punished with a warning or above depending on the severity of the case.

2) Those who intentionally or negligently disseminate improper information including obscenity, instigation of illegal crime, crime methods or cheating methods in exams shall be punished with a severe warning or above depending on the severity of the case.

3) Those who intentionally or negligently produce, publish or disseminate information that is prohibited by laws and regulations, or commit any other act endangering the security of the network, shall be punished with a severe warning or above depending on the severity of the case.

4) Those who leak secrets and cause adverse consequences shall be punished with a severe warning or above depending on the severity of the case.

5) Those who invade into the computer information system, steal or tamper with the system functions, applications or data stored, processed or transmitted in the system, or cause loss or damage to the data or applications, shall be punished with a severe warning or above depending on the severity of the case.

6) Those who intentionally or negligently spread computer virus or cause damage to computer system or network shall be punished with a severe warning or above depending on the severity of the case.

Article 19 Students who violate the regulations on dormitory management shall be punished according to the following regulations:

1) Those who violate the regulations on electricity use shall be punished with a warning; those who show no sign of regret or who use open fire without causing severe consequences shall be punished with a demerit record or less; those who cause severe consequences shall be punished with a demerit record or above.

2) Those who do not return to the dormitory at night or rent an apartment off campus without permission shall be punished with a severe warning or above.

3) Those who fail to go through the formalities of asking for leave and return late for three or more times in a semester shall be punished with a warning or above.

4) Those who raise pets on campus and affect the environment but fail to make correction within the time limit after admonition shall be punished with a warning or above.

5) Any other act in violation of the dormitory management regulations shall be punished with a warning or above.

Article 20 Students who impair the university order or the administration of social order shall be punished according to the following regulations:

1) In case of any of the following acts, students shall be punished according to the seriousness of the case:

a) Those who insult, defame, intimidate, retaliate or frame others by means of the Internet, letters, telephone or direct intimidation, etc., shall be punished with a demerit record or below if the circumstance is minor, a demerit record or above if the circumstance is severe.

b) Those who conceal, destroy, discard, dismantle others’ mails without permission, or hinder others’ freedom of communication, shall be punished with a demerit record or below if the circumstance is minor, a demerit record or above if the circumstance is severe.

c) Those who conceal the truth, deceive others, lure others to purchase and loan on the Internet, or have dishonest behaviors such as faking online orders, and cause damage to other people’s property and reputation, shall be punished with a warning or above.

d) Those who organize, plan, participate in fighting or provide lethal weapons shall be punished with a warning or above according to the severity of the circumstances and the consequences, among which those who cause minor injuries to others shall be given a demerit record or academic probation; those who cause severe injuries to others shall be expelled from school; those who plan and organize the events shall be given exacerbated punishment.

e) Those who engage in voyeurism or sexual assault will be punished with a severe warning or a demerit record; in more severe cases, they will be put on academic probation or expelled from school.

2) In case of any of the following acts, students shall be punished according to the severity of the case:

a) Those who divulge secrets and forge certificates and seals shall be punished with a demerit record or above depending on the severity of the circumstances and the consequences.

b) Those who forge, alter, falsely claim, misappropriate or transfer supporting documents of all kinds shall be punished with a warning or above depending on the importance of the supporting documents and the severity of consequences.

c) Those who provide false evidence, forge evidence, tamper with personal information, etc. shall be punished with a severe warning or above depending on the severity of the case.

d) Those who harbor stolen goods, conceal evidence and lethal weapons or cover up for others, shall be punished with a severe warning or above depending on the severity of the case.

e) In the process of investigation on all kinds of severe violations of policies, those obstruct the investigation by providing false evidence or lie to the investigation team shall be punished with a warning or severe warning; those who mislead the investigation team by providing false evidence shall be punished with a demerit record or academic probation; those who cause severe consequences shall be expelled from the university.

f) Those who attend classes on behalf of others, sign up for others, or conduct other dishonest behaviors, shall be punished with a warning or above.

g) Those who cause adverse effects in the interaction between male and female shall be punished with a warning or above depending on the severity of the case; those who cause extremely severe consequence shall be expelled from the university.

h) Those who obstruct or refuse state officers or school administrators to perform official duties according to law or regulations shall be punished with a demerit record or below; those who cause severe consequences shall be punished with a demerit record and above.

i) Those who provide conditions for gambling or participate in gambling shall be punished with a severe warning or above depending on the severity of the case.

j) Those who take drugs, instigate or induce others to take drugs, though do not constitute a crime, shall be punished with a severe warning or above depending on the severity of the case.

k) Those who violate relevant laboratory management regulations, shall be punished with a warning or above depending on the severity of the case and the consequences.

l) Those who engage in commercial activities without permission, interfere with the normal campus order, or violate the relevant regulations in the work-study activities organized by the school, shall be punished with a demerit record or below.

3) In case of any of the following acts, students shall be punished according to the severity of the case:

a) Those who use the Internet and other new media to generate and spread rumors or use other means to confuse the public and create chaos, incite strike and fasting, impair the reputation of the university and endanger the stability of the campus, shall be punished with a demerit record or below if the circumstance is minor, a demerit record or above if the circumstance is severe.

b) Those who pick a quarrel or make trouble after drinking shall be punished with a warning or above; those who disturb public order in public places such as restaurants, classrooms, dormitories and conference halls shall be punished with a demerit record or below; those who disobey the advice or cause severe impact will be punished with a demerit record or above.

Article 21 Any other act that smears the image of the university, undermines the order of teaching and living, disrupts the management of public places, and infringes upon the legitimate rights and interests of other individuals and organizations shall be punished with a warning or above depending on the severity of the case and the consequences.

Chapter IV Procedure and Authority of Disciplinary Punishment

Article 22 The punishment of students shall be managed at different levels and submitted for approval in accordance with the procedures. Relevant departments should report the case to the relevant school and the Student Affairs Office within 2 working days. The Student Affairs Office is responsible for supervising and reporting the results of disciplinary sanctions to relevant departments and personnel in a timely manner.

Article 23 The school to which the student belongs shall be responsible for the decision of disciplinary sanctions, and should submit the decision to the relevant departments for signature, and then to the Leading Group of Student Management for approval after approved by the Student Affairs Office; expulsion punishment shall be put forward by the Leading Group and submitted to the University Council or the meeting authorized by the Principal for investigation and decision-making, and a review of the legitimacy shall be conducted in advance.

Article 24 A disciplinary sanction verdict must be presented and sent to the student before the punishment is implemented. The verdict shall include the following information:

1) Student’s name, gender, date of birth, school, class and other basic information

2) Facts and evidence of violation of laws and regulations or university rules and regulations

3) Type, basis and time limit of the punishment

4) Appeal method and deadline

5) Name of the university, date of punishment and other necessary information.

Article 25 Before a sanction decision is made, students shall be informed of the facts, reasons and basis for the decision, and they have the right to make a statement and pleading, which should be heeded to.

Article 26 Except for the expulsion, the punishment shall be given a time limit of 6 to 12 months (6 months for the punishment of warning, severe warning and demerit record, and 12 months for the academic probation). The starting time shall be counted from the date the punishment is issued. The specific measures for canceling the punishment shall be formulated separately. If the student is suspended from university for any reason during the period, the time of suspension will not be counted as part of the punishment period.

Article 27 Students who commit two or more acts that require disciplinary sanctions shall be punished according to different circumstances: if the types of sanction are different, the most severe one shall be imposed; if they are of the same type (except for expulsion), the punishment shall be imposed, and the time limit shall be at least 6 months long and less than the sum of all the punishment periods. If a student is given a new punishment within the punishment period, the time shall be the unexecuted period and the new punishment period combined. The maximum punishment period is 24 months.

Article 28 The verdict letter shall be delivered to the student or his/her representative within 7 working days from the date of issuance and a return receipt shall be signed by the student or his/her representative. If the student refuses to sign, the staff from relevant school should state the situation on the return receipt, and the receipt shall be signed by two witnesses. If the student has left the campus, the verdict letter shall be delivered by mail.

In other cases where the verdict letter cannot be delivered, the university shall announce the situation on its official website, and the letter shall be considered as delivered 30 days from the date of announcement.

Article 29 Students who commit disciplinary violations during the academic probation shall be expelled from the university.

Article 30 Students who have been expelled from the university should be reported to the Education Department of Jiangsu province for filing within 10 working days from the date the disciplinary verdict is issued.

Article 31 Students who have been expelled from the university shall complete the procedures for leaving within 10 days from the date they receive the disciplinary verdict or the appeal verdict that maintains the original decision. If the student fails to do so within the time limit, the school to which the student belongs shall be responsible for handling the relevant formalities, and the Security Office, together with his/her school, shall order the student to leave the campus within a time limit. Students who have been expelled from school shall be issued a proof of study by the university. Their archives shall be returned to their family addresses, and their hukou (registered permanent address) shall be transferred back to the original registered place or where their family is registered in accordance with the relevant provisions of the state.

Article 32 The materials for punishment and completion of punishment shall be truly and completely included in the university’s documents and archives.

Chapter V Supplementary Provisions

Article 33 Students who refuse to accept the decision or the implementation of punishment shall appeal to the Student Complaint Handling Committee of the University. The office of the committee is located in the Legal Work Office. The specific measures for students to appeal shall be formulated separately.

Article 34 The “above” or “below” referred in these regulations shall include the level mentioned.

Article 35 The regulations shall come into force as of September 1st, 2017, and the Student Affairs Office reserves the right of interpretation. “The Regulations on Disciplinary Sanctions of Students of Jiangnan University (President Office of Jiangnan University2014No.23” shall be repealed simultaneously.
